For a subscription taken out on the website, the sale is made by Stripe, the merchant of record for the subscription: Stripe collects the payment, calculates and remits the taxes of your country and handles refunds. For a subscription taken out in the iOS or Android app, the sale is made by Apple or by Google, on behalf of the publisher (see article 4).
2. Purpose
These terms apply to the Humido Premium subscription, which unlocks additional features of the app and the website, including:
- the advisor;
- the pairings;
- advanced humidor maintenance;
- release alerts;
- the detailed taste profile;
- a higher number of scans.
The up-to-date list appears on the Premium page. Use of Humido remains governed by the terms of use. The subscription covers a digital service: Humido does not sell any tobacco products.
The subscription is not offered to persons residing or established in a country or territory subject to international economic sanctions (including Cuba, Iran, North Korea, Syria and the regions of Crimea, Donetsk and Luhansk), nor may it be purchased from those countries or territories. The pages of the site devoted to cigars from these origins are purely informational and do not constitute an offer for sale.
3. Prices
| Plan | Price incl. tax |
|---|---|
| Monthly | €4.99 per month |
| Annual | €34.99 per year |
- Price. Prices are shown including all taxes. For a purchase on the website, the taxes of your country (VAT or sales tax) are included, calculated and remitted by Stripe.
- Currencies. On the website, the price is shown and paid in the currency of your country when it is offered (amounts on the Premium page), otherwise in euros.
- Store prices. They may differ depending on the country and the currency, because Apple and Google set them locally.
- Price change. A price change only applies to the following period, after prior notice. You can cancel before it takes effect.
4. Subscribing
- Account required. Subscribing requires a Humido account with an email address. It is not possible in guest mode.
- One status for everything. The subscription is attached to your account: it is active in the app as well as on the website, wherever you took it out.
- On the website (humido.app/premium): you choose the plan, tick the box requesting immediate access (article 7), then pay on the Stripe checkout page, Stripe being the merchant of record for the subscription on the website. The purchase is then also subject to Stripe's terms. The contract is concluded when the payment or the free trial is validated. A confirmation is sent to you by email.
- In the app: the purchase is made through the payment system of Apple (App Store) or Google (Google Play). It is then also subject to Apple's or Google's terms of sale.
- One subscription only. If a subscription is already active through one payment method, you cannot take out a second one through another.
5. Free trial
A first subscription begins with a 14-day free trial, once per account. For Apple and Google, the trial is granted once per store account.
- During the trial, you enjoy all Premium features.
- If you cancel before the end of the trial, you pay nothing.
- Otherwise, the plan you chose starts at the end of the trial and the first payment is charged that day.
- A reminder is sent to you before the end of the trial.
6. Term, renewal and payment
- Renewal. The subscription is concluded for one month or one year. It is renewed automatically for the same term, unless cancelled.
- Payment. It is charged at the start of each period to the payment method registered with Stripe, Apple or Google. If a payment fails, access is maintained during the provider's retry period, then suspended.
- Annual plan. We notify you by email, between three months and one month before the renewal date, of the date from which you can refuse the renewal (article L215-1 of the French Consumer Code (Code de la consommation)).
- Invoices. They are sent by Stripe for a subscription taken out on the website. For a purchase in the app, Apple or Google send you the receipt.
7. Right of withdrawal
You have, in principle, a period of 14 days from subscribing to withdraw, without giving a reason.
For a first subscription, the 14-day free trial covers this period: you can cancel free of charge during the trial.
On the website, for a subscription without a trial, you can ask to access Premium immediately. You then tick a box by which:
- you request immediate performance of the service;
- you acknowledge that you waive your right of withdrawal as soon as access begins (article L221-28, 13°, of the French Consumer Code (Code de la consommation)).
The date of this request is kept, and it is confirmed to you by email. Stripe, merchant of record on the website, may also grant a refund under its own rules.
In the app, the right of withdrawal and refunds are handled by Apple or Google, under their rules. Requests are made to them: reportaproblem.apple.com for Apple, the Google Play order history for Google.
8. Cancellation
You can cancel at any time, in a few clicks, without charge or supporting document. Cancellation takes effect at the end of the period already paid. You keep Premium until that date. Periods already begun are not refunded, unless the law provides otherwise.
| Subscription taken out | From the app | From the website |
|---|---|---|
| on the website (Stripe) | Settings > Subscription > Cancel | My account > Settings > Subscription > Cancel |
| on Google Play | Settings > Subscription > Cancel | My account > Settings > Subscription > Cancel |
| on the App Store | Settings > Subscription > Manage with Apple | link to Apple's subscription management |
For an App Store subscription, only Apple can record the cancellation: Humido takes you there directly.
Each cancellation is confirmed by email. Deleting your account automatically cancels a Stripe or Google Play subscription. An App Store subscription must be cancelled with Apple.
We may end the subscription in the event of a serious breach of the terms of use (article 10 of the Terms of Use).
9. Conformity of the service
Humido Premium benefits from the legal guarantee of conformity of digital content and services (articles L224-25-12 et seq. of the French Consumer Code (Code de la consommation)). In the event of a defect, write to support@humido.app. We will bring the service into conformity within a reasonable time. Failing that, you may obtain a price reduction or terminate the contract with a refund for the period concerned.
If an important Premium feature is removed during a subscription, you are informed and may cancel with a pro rata refund of the remaining period.
10. Customer service and complaints
Write to support@humido.app or use the form at humido.app/contact. We reply within 7 working days.
11. Mediation
In the event of a dispute not resolved with our customer service, you can refer the matter, free of charge, to the consumer mediator:
CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice
49 rue de Ponthieu, 75008 Paris, France
Website: www.cm2c.net – online request: www.cm2c.net/declarer-un-litige.php
You must first have sent a written complaint to support@humido.app, less than one year before referring the matter to the mediator.
12. Governing law
These terms are governed by French law. Failing an amicable agreement or mediation, the dispute is brought before the competent courts. If you are a consumer, this may be the court of your place of residence.
